All applications for the use of the premises
or any part thereof shall be made on the Application Form and be returned
to the Theatre Management together with the deposit. Until this form has
been completed and returned with the deposit the Company shall be at
liberty to let the premises or any part thereof to another applicant. The
Company reserves the right to refuse any application for the use of the
premises or any part thereof without stating their reasons for such
refusal.

The term “Hirer” in these conditions shall be
taken to mean the persons or body making application to hire the premises
or any part thereof.

The Company reserves the right to cancel
bookings in the event of a breach of contract by the Hirer which the Hirer
fails to remedy following due notice in writing specifying the breach. The Hirer
therefore shall not be entitled to any compensation in consequence thereof
or in any connection therewith other than the refunding of the appropriate
hiring fees paid under Condition 1 hereof.

Should the Hirer cancel the booking of the
premises or any part thereof for any reason, within 3 weeks the Hirer will
be liable to pay the full hiring fee. The deposit of the hiring fee under
Condition 1 hereof shall be forfeited but, in the event of the premises of
any part thereof being re-let for the date and during the period of the
cancelled booking would have taken place, the said hiring fees shall be
refunded to the extent that the Company have re-covered themselves by
reason of the premises or any part thereof having being re-let.

The cost of the hiring will be the amount
applicable at the time of payment.

The Hirer shall be responsible and accept
responsibility for any damage done to the premises or any part thereof,
furniture, utensils or other property of the Company during the period of
or otherwise arising out of the hire of the premises or any part thereof.

Hirers will be strictly liable for the cost
of replacing or repairing equipment and/or any part of the building to
which the damage has been caused.

No entertainment shall beheld or given which
will involve any increased risk of fire or vitiate any policy of insurance
of the Company, without seven days notice in writing to the Theatre
Manager and any special insurance arranged for by the Company, the Hirer
paying the additional premium required.

If pyrotechnics are used the Hirer must give
at least 28 days notice and a copy of the licence to the Theatre Manager.
The Management reserves the right to prohibit the use of pyrotechnics if
in the opinion of the Theatre Manager pyrotechnics are being used
dangerously, carelessly or otherwise inappropriately.

The Company accept no responsibility for any
loss or damage sustained in respect of articles, wearing apparel or any
other property bought into or left in the premises or any part thereof by
or on behalf of the Hirer or any other person.

The Hirer shall ensure that:
a) There is No Smoking in the auditorium at any time, save
where required in the course of the performance of a play.
b) No hot or alcoholic drinks of any kind are to be taken into the
auditorium.
c) No Painting on the without adequate protection of floor
and surrounding areas.
d) No Fixings to stage floor and walls. If however,
fixing is necessary an application should be made to the
management 14 days prior to the hiring.
e) The Fire Curtain is lowered at least once in the presence
of the audience.
f) No de-rigging of curtain tracks.

The Company’s officers will arrange all
seats, with sufficient gangways in all respects to afford means of rapid
exit and the Hirer shall keep such gangways together with all passages and
exits free from obstruction.

All doors giving access
from the premises or such part thereof as is being hired shall be kept
unfastened and obstructed and immediately available for exit during the
whole such time a Hirer is using them.

No fewer than four front
of house staff (excluding programme sellers, those involved in raffles and
merchandising etc) shall arrive 15 minutes prior to opening and be ready
for duty by 6.30pm or one hour before the performance is due start. The
Theatre doors will not open until a minimum of four front of house staff
are on duty.

If the front of house
staff, by act or omission, allow any person to sit anywhere in the
Auditorium other than in a designated seat or to stand in the auditorium
or exceed the seating capacity or otherwise jeopardize safety or the
Theatre’s licence then this may result in the immediate cancellation of
the performance during which the act or omission is discovered and all
subsequent performances. Any costs or financial losses incurred will be
the sole liability of the Hirer and any fees due to the theatre will
become payable.

If merchandise of any kind
(other than programmes) is to be sold, permission should be sought and
full details in respect of its nature and display given to the Management
14 days prior to the hiring. Any merchandise sold is subject to a fee of
10% of its retail value.

If there is to be a
charity display then permission should be sought and full details of the
display given to the Management no less than one month prior to the
hiring. Any display must be mounted during the day by arrangement with the
Management, prior to the theatre opening in the evening.

The directions for Stage
Managers must be read and signed as read by the Stage Manager in the
presence of the Management before the Hiring can commence.

Whoever holds the
production keys (normally expected to be the Stage Manager) is solely
responsible for opening the Theatre to performers and crew. He/she must
therefore be at the Theatre by the time the first members of the cast and
crew are due to arrive.

Cast and crew to enter
the Theatre via the stage door at all times.
(The entrance on the street next to the fire
door entrance and/or the back entrance door). The foyer doors will not be
opened until 6.30pm or 1 hour before performance commences.

The Company reserve
themselves the right of entry for their and Exeter City Council’s duly
authorised officers or servants, fire, police or ambulance officers on
duty to the premises or any part thereof at all times, and require that
the attendants employed by the Hirer shall be instructed accordingly.

The Hirer shall not use
the premises or any part thereof for the performance in public of any
dramatic of musical work or for the delivery in public lectures in which
copyright subsists without the consent of the said owner of the said
copyright. The Hirer shall indemnify the Company against all sums of money
which the Company may have to pay by reason of any infringement of
copyright occurring during the whole of such time as the premises of any
part thereof is being used by the Hirer. Where music in any form comprise
part of the event, a form of return showing particulars of musical items
performed, as required by the Performing Rights Society Ltd., shall be
completed, signed and returned to the Theatre Manager not later than 14
days before the performance thereof.

The Hirer shall not
sub-let the premises or any part thereof.

If the Hirer shall
continue his occupation of the premises or any part thereof after the time
for which he engaged the same, he shall pay such additional sum as may be
specified in the Scale of Charges in respect of such holding-over. He
shall in addition be responsible for any loss or damage occasioned to the
Company by reason of such holding-over.

The capacity of the
auditorium for plays and concerts etc. is 289 seats; of the Bedford Studio
up to 100 for dancing; 80 flat floor seating and 59 for raked seating. No
ticket holder for any function or performance on the premises or any part
thereof shall be allowed entry or re-entry to the premises after 10pm.

The premises are licensed
annually for music and for dancing, and for Cinematograph performances
until 11pm daily except on Good Friday and Christmas Day. The Hirer shall
be deemed to have notice of the Conditions attached to such licences and
shall observe and perform such conditions in so far as they affect the
hire. The Theatre Manager at the request of the Hirer will apply for any
extension of the Public Entertainments Licence.

The Hirer shall not use or
permit to be used any or all of the stage lighting or other stage
equipment except where such is under the supervision of a suitably
qualified person previously approved for such purpose by the Theatre
Manager. If no such qualified person is proposed by the Hirer the Company
shall have the right to insist that the lighting and other stage equipment
is used only under the supervision of the Company’s representative and in
such a case a fee will be charged.

All lighting and
associated equipment required in excess of the standard rig supplied by
the Theatre must be supplied by the Hirer. Spare lamps will be supplied
with the discretion of Theatre’s technician and charged accordingly.

Any lighting, fixtures or
fittings that are moved or altered must be returned or restored to their
former position.

Any work undertaken by
Theatre staff in relation to 28 above will be charged at an hourly rate
(rounded up).

Any other work undertaken
by the Theatre staff that is determined by the management to be in excess
of the work normally to be expected in connection with a hiring will be
charged at hourly rate (rounded up).

The Hirer shall at all
times ensure that persons on or leaving the licensed premises conduct
themselves in any orderly manner and do not in any way cause annoyance to
residents and persons passing by. The volume of amplified sound used in
connection with the entertainment on the premises shall be at all times be
under the control of the Management.

No alcoholic liquor may be
sold on the premises except from the Bar opened by the Company. No
alcoholic liquor other than such have been purchased from the said Bar may
be consumed by anyone on the premises except by prior arrangement with the
Theatre Manager. Alcoholic liquor provided by the Hirer at his expense for
free distribution to persons attending the function for which he has hired
the premises or any part thereof will be liable to a corkage charge.

No fly posting must take
